Copyright and Trade Design
These images are scans of plans signed (and in many cases dated) by the Chief Mechanical Engineers of the day, notably
- Frederick James Shea: SAR CME 1923 - 1939;
- Frank Harrison: SAR CME 1939 -1952;
- AA Pryce: SAR CME 1953 -??.
The original pages appear quite old and many pages have yellowed with age.
Based on the advice contained within the above linked Federal Government websites, it would thus appear that these plans are past design protection (10 years) and are also not subject to copyright protection.
- Copyright: Most plans pre-date 1 January 1955 (50 years prior to 1 January 2005, the change-over date of copyright protection in Australia) and most are over 60 years old from first publication. It is not believed that there are any copyright issues associated with these plans as time elapsed since first publication exceeds 54 years (G010.PDF at www.copyright.org.au - page 3 states inter alia that "A State, Territory or Federal Government will usually own copyright in material created, or first published by it or under its direction or control.").
http://www.ipaustralia.gov.au/ip/copyright.shtml also states "Material is protected from the time it is first written down, painted or drawn, filmed or taped.".
However, copyright is probably not an issue: http://www.ipaustralia.gov.au/ip/copyright.shtml clearly states in paragraph seven that "Copyright is lost if the owner applies a three-dimensional artistic work industrially. In such a case, it is necessary to register the design if protection is required." These plans were certainly used industrially.
Which leads us to ........
- Trade Design: http://www.ipaustralia.gov.au/ip/designs.shtml states under Duration of protection: "Registration initially protects your design for five years. You can then renew the registration for a further five years."
I place this note here as I've received a (forged?) email purporting to be from a solicitor at Mintner-Ellison alleging breach of copyright (the email actually said "breech of copyright" which in itself has to be a bit "suss"{never seen a solicitor's letter where they couldn't spell basic words properly)). I've spoken to the solicitor at Mintner-Ellison in Adelaide who tells me no such email was sent from their offices and that there are no copyright issues associated with these plans.
